The WRC recommended that a facilities management company pay a manager €12,500 after finding it dismissed him without fair procedures during a probation review. In a recommendation dated 22 May 2025, adjudication officer Jim Dolan said the decision to dismiss the worker had been made before the meeting.
The manager said he was invited to a probation review, not a disciplinary hearing, and had no chance to answer allegations. His six-month probation expired on 3 June 2024, before his employment ended on 27 June. The company did not attend the hearing. Dolan said employees on probation are entitled to natural justice and fundamentally fair procedures. He described the 21 June meeting as an “ambush” and recommended payment within 42 days.
