The WRC recommended €14,000 compensation for a general manager dismissed without fair procedures by a hotel and restaurant. The recommendation under section 13 of the Industrial Relations Act 1969 was dated 23 August 2023.
The worker denied the allegations against her and said she was dismissed by letter without an investigation or disciplinary meeting. The employer said it dismissed her over her conduct, including alleged sleeping while on duty and aggressive behaviour. The adjudicator found the employer had not supplied evidence to support its allegations and had not followed fair procedures or its own dismissal process.
The recommended compensation reflected that the worker had returned to work without a medical certificate confirming she was fit and that a bonus she claimed was not certain to be paid. The adjudicator also recommended that any alleged disparagement of the worker to potential employers or in public cease immediately.
