The WRC recommended that a catering company pay a worker €35,000 after finding that a redundancy cap had disadvantaged her following more than 32 years’ service.

The company had previously paid statutory redundancy plus two weeks’ pay for each year of service. During the Covid pandemic, it capped payments at one year’s salary, including statutory redundancy benefit. The worker received €3,172 above her statutory entitlement under the cap.

The WRC recommendation was dated 29 February 2024. The company did not attend the hearing. The officer recommended the payment alongside a confidential agreement to prevent the recommendation being used as a precedent.
