Labour Court says Stobart must consult union before assigning transferred Tesco drivers to non-Tesco work

The Labour Court said Stobart (Ireland) Limited must consult the Services Industrial Professional Technical Union before integrating transferred Tesco drivers into non-Tesco-related work. The decision was signed on 9 December 2010. The union argued that the agreements limited drivers to Tesco stores, distribution centres and related sites. The Court found the work-flexibility clause allowed new routes and other duties, but not non-Tesco-related driving. It said the proposed integration went beyond what was envisaged when Tesco’s network distribution business transferred to Stobart, and required further consultation with affected staff and the union under the existing agreements.
