The Labour Court affirmed a Rights Commissioner’s decision against Madeline Keeley Burke after she failed to attend her appeal hearing or provide a written submission. The Court’s decision is dated 21 February 2024. The appeal concerned her complaint against St James Hospital under the Safety, Health and Welfare at Work Act 2005. The Rights Commissioner had found the complaint not well founded. The Labour Court said Burke had been notified of the hearing through her legal representative. St James Hospital attended and filed a written submission, while Burke did not attend or provide one despite reminders. Because she could not advance her appeal, the Court affirmed the earlier decision; the merits were not decided by the Labour Court.
