The Labour Court affirmed a Rights Commissioner’s finding against Madeline Keeley Burke after she failed to attend her appeal hearing or provide a written submission. The Court’s decision is dated 21 February 2024. The appeal concerned her complaint against St James Hospital under the Health Act 2004, as amended by the Health Act 2007. The Rights Commissioner had found the complaint not well founded. St James Hospital attended and submitted written arguments, while Burke did not attend despite being notified through her legal representative. The appeal failed, and the earlier finding was affirmed; the merits were not decided in the appeal.
