The Labour Court dismissed Tariq Shaikh’s appeal against J & J Visioncare Products Ireland Ltd t/a Vistakon Ireland and upheld the Rights Commissioner’s decision, in a determination signed on 10 December 2012. Shaikh said he was dismissed and moved to another production line after complaining about a co-worker. The company said his dismissal during probation followed a failure to make the progress needed for a permanent role. The Court found that Shaikh was dismissed because he had not shown the skills and aptitude required for the job, and that the move to another line was part of his training. It found the complaint was not well founded.
