The Labour Court upheld a €5,000 compensation award to emergency medical technician Annamay Tiernan on HSE Dublin North East’s appeal, while rejecting her claim over refusing to operate an ambulance alone. The determination was signed on 9 October 2008.

Tiernan declined a patient transfer while working alone, citing safety concerns. The Court found she had received assurances and should have carried out the transfer under protest, so it did not uphold that penalisation claim.

The Court upheld her separate claim that the HSE penalised her after she complained to the Health and Safety Authority: her disciplinary process was raised from Stage 2 to Stage 3, and the Court found HSE procedures uncertain and misused. It awarded her €5,000 compensation.
