Labour Court dismisses worker’s claim over alleged harassment

By Saoirse Doyle

Labour Court ·

In 1993, the Labour Court dismissed a worker’s claim that she was constructively dismissed after alleged sexual harassment by a supervisor. The Court found that the employer had not discriminated against her. Its decision was signed on 16 September 1993.

The trainee shop assistant said the supervisor made advances while she was walking home from work, and that she was sent home on two later shifts before being dismissed. The company rejected her allegations. The Court said the employer could not be responsible for an incident in a public place outside work where it had no control. After receiving her complaint, the employer interviewed the supervisor, checked with gardaí whether a complaint had been made, and changed the roster so they would not work together. The worker did not work with him again.
