Murphy said a chef had sexually harassed her over an extended period and described a physical incident before she resigned. The employer’s proprietor denied receiving complaints and disputed her account of why she left. The Court found that the harassment occurred and that the proprietor knew about the conduct but failed to take appropriate action. It also considered the employer’s lack of a written anti-harassment policy and complaints procedure when assessing compensation.
