The Labour Court rejected Peter Ogurčák’s appeal against Mercato Ltd. over his claim of race discrimination in pay. In a determination signed on 12 September 2025, it affirmed the Adjudication Officer’s decision that the complaint was not well founded.
Ogurčák alleged he was paid less proportionately than an Irish colleague doing the same work, because he worked longer hours, and said the colleague received a €3,000 annual bonus he did not get. The Court accepted that their roles involved like work, but found Ogurčák had not established that longer hours meant lower pay. His salary was €5,000 higher annually, and the Court accepted the colleague met his contractual hours; Ogurčák received time off in lieu for hours outside normal business hours. Mercato disputed the bonus claim.
