The Labour Court upheld the Health Service Executive’s appeal and set aside a €1,000 award to Claire Barnes over an age-discrimination complaint concerning the Pandemic Payment. The determination was dated 7 October 2024.
Barnes said she was refused the payment despite knowing of a coworker ten years older who received it. The HSE argued that she did not meet the payment criteria and that age played no part. The Court found she had not established a link between her age and the decision, so her complaint was not well founded.
