Labour Court sets aside €2,000 award in Neville Hotels sexual harassment appeal

The Labour Court set aside a €2,000 award against Neville Hotels after finding there was no valid sexual harassment complaint before the WRC. The Court said the issue was first raised at a hearing in May 2023, outside the statutory time limit.

Vanessa Corral Fernandez had alleged sexual harassment at work. Neville Hotels denied the allegation and argued that no such complaint had been properly lodged. The WRC had upheld her complaint and awarded €2,000 in compensation.

In a determination dated 15 July 2024, the Labour Court allowed Neville Hotels’ appeal and set aside the WRC decision. Fernandez had also cross-appealed; the determination does not state a separate outcome for that appeal. Because the complaint was out of time, the merits were not decided.
