The Labour Court refused Cavtat Taverns 3 Limited T/A Urban Eats an extension to appeal a €25,000 award to Ingrid Guimaraes Hanlon, leaving the award in place. The determination was dated 17 April 2023.
An Adjudication Officer had found Hanlon's complaints of gender discrimination and harassment well founded. The employer sought more time to appeal, saying it had not received notice of the first-instance hearing or decision. Hanlon opposed the application in a written submission but did not attend the appeal hearing.
The Court found that correspondence had been sent to the employer's business address at Dublin Airport and that the employer had not shown exceptional circumstances preventing a timely appeal. It refused the extension; it did not reconsider the underlying complaints.
