The Labour Court rejected Carol Murphy’s disability discrimination appeal against the Irish Horse Racing Regulatory Board, affirming the Adjudication Officer’s decision in a determination dated 28 January 2021.
Murphy argued that training for judging work would have suited her abilities and allowed her to work more days. The Board said it had modified her veterinary assistant duties after learning of her medical condition, including removing urine-sampling work, and that no judging vacancies had arisen since 2017.
The Court found the changes allowed Murphy to continue in her job without reducing her contracted annual duty days. It said judging was a different role requiring specialised training and found no identifiable facts within the claim period establishing a breach. The Court concluded the Board had provided reasonable accommodation and disallowed the appeal.
