The Labour Court rejected a worker’s appeal and upheld the Equality Officer’s decision, in a determination dated 7 February 2011. The Court found it had no jurisdiction to examine the worker’s race discrimination, harassment and victimisation complaints because he had not shown that the company’s misrepresentation caused his delay in bringing them; the merits were not decided. The Court found that the worker and a comparator performed like work, but that the pay differences were lawful. The comparator received a share-option grant after a promotion, while the worker had transferred roles and had already received a director-level grant. Their 2005 share-option and bonus differences reflected their performance ratings. The worker received a €9,200 bonus and the comparator €14,800.
