The Labour Court allowed Zoe Developments Limited’s appeal and set aside the Rights Commissioner’s finding that Damien Reville’s holiday-pay complaint was well founded. The determination, dated 20 October 1999, found the complaint not well founded. SIPTU argued that travelling-time payments formed part of normal weekly pay; the company said they covered work-related expenses. The Court found the agreements classified the payments as expenses, not pay. A separate industry agreement provided for their inclusion in holiday pay from 1 September 1999, and the determination did not affect that agreement.
