The Labour Court overturned a Rights Commissioner’s £100 net-pay recommendation to a worker after finding she had received her annual leave entitlement. The determination was dated 16 December 1998. The worker had claimed payment for three additional holiday days under the Organisation of Working Time Act, 1997. The Court found she had taken 15 days’ annual leave and received Christmas Eve as leave, giving her 16 days for the year. It said she had no legal entitlement to compensation for outstanding annual leave. The company had argued that she received her full entitlement. The Court also noted that she had no written contract and that the company’s annual-leave records were inadequate.
