The Labour Court has rejected Lourda Finn’s appeal against the Health Service Executive (HSE), finding the HSE was not her employer. The decision was signed on 16 January 2025. Finn alleged the HSE failed to keep records required under the Organisation of Working Time Act 1997. The HSE said an employment agency employed her and assigned her to work with the service. The Court found that the agency was her employer, affirmed the adjudicator’s decision and did not proceed to a substantive hearing of the records complaint.
