The Labour Court overturned an earlier ruling and awarded Declan Gargan €500 in compensation after finding he had been underpaid for accrued annual leave. The decision was dated 13 August 2024. Gargan appealed after an adjudication officer found his complaint against former employer Shapoorji Pallonji Europe Limited was not well founded. He said he was owed payment for 11.2 days of unused leave. The Court calculated his entitlement at €2,688 and found a shortfall of €291, after considering a payment of €2,367 documented at the end of his employment and Gargan’s account that he received €2,397. It ordered €500, which it considered just and equitable. The company’s liquidator did not attend the hearing.
