The Labour Court dismissed Muresan Gavril’s appeal over a claimed shortfall in weekly hours, affirming the Adjudication Officer’s decision. The decision was signed on 13 August 2024. Gavril said Mercury Security & Facilities Management Limited failed on several occasions to provide 40 hours’ work per week, despite a contract providing for hours in excess of 40 weekly on a variable rota. He claimed that 292.5 hours were short between September 2022 and March 2023, valued at €4,095, and sought compensation under the Organisation of Working Time Act 1997. The Court found the Act did not provide redress for the complaint as framed, so the appeal failed. The claimed amount was not awarded.
