The Labour Court dismissed Arkadiusz Brzezinski’s appeal over the filing deadline for his working-time complaint against Aronmar Plant Limited. The decision is dated 13 August 2024. The Court found he had not shown reasonable cause for the delay and affirmed the adjudication officer’s decision that the complaint was out of time; the merits were not decided. Brzezinski alleged breaches involving rest periods, daily working hours and notice of working hours under the Organisation of Working Time Act 1997. He said his first language, lack of an employment contract and lack of knowledge of his legal entitlements explained the delay. Aronmar opposed an extension and pointed to his obtaining legal advice in September 2022.
