Late appeal leaves €500 award against El Grito Mexican Taqueria in place

The Labour Court upheld a €500 award to Paola Alba Dalivar after El Grito Mexican Taqueria’s appeal was received about five weeks after the statutory deadline. The determination was dated 31 October 2023. The employers sought more time, saying they had not been notified of the first hearing and were shocked by the decision. They also argued that related awards could mean double recovery. The Court found those circumstances were not exceptional and refused to extend the deadline. The appeal failed on timing, so the merits were not decided.
