The Labour Court refused Mr Paul McDonnell an extension of time for his annual-leave complaint against Bus Eireann. The determination was dated 14 January 2022. The complaint concerned a wage deduction on 23 July 2020 relating to days of annual leave McDonnell had taken. He referred it on 2 February 2021, after the six-month time limit had expired. McDonnell said ongoing discussions between his union and Bus Eireann about annual leave explained the delay. The Court found that explanation did not excuse the delay and said he should have referred the complaint when it became apparent the internal process was unlikely to finish within the time limit. The merits were not decided.
