Labour Court upholds €2,824.12 award after employer fails to attend appeal

The Labour Court upheld a €2,824.12 award to James Andrew after WS Earthworks Limited failed to attend its own appeal. The Court’s determination was dated 28 September 2022. The award followed breaches of Andrew’s rights under the Organisation of Working Time Act 1997. The Court said the respondent, as appellant, was not in a position to make an appeal and that it had no valid appeal before it for consideration. The original award therefore remained in place; the merits were not decided.
