The Labour Court has rejected Mr Kevin Ireland’s appeal over the time limit for his working-time complaint against Corrib Oil Company Unlimited Company T/A Corrib Oil. The determination was dated 24 August 2022; the merits were not decided. Ireland, a lorry driver, resigned on 11 January 2019 and referred his complaint on 22 December 2019, about eleven and a half months later. He said ongoing psychiatric injury had prevented him from referring it within the six-month limit. The Court found no cogent reason for the delay. It relied on medical evidence that his condition had resolved within six to eight months of leaving, and on evidence that he had secured other work before resigning and continued driving without issue. The appeal failed because the complaint was out of time.
