Labour Court awards Declan Healy €1,500 over unpaid Sunday work

The Labour Court awarded bus driver Declan Healy €1,500 after finding Dualway Coaches Dualway Group had not compensated him for nine Sundays as required by law. In its decision dated 11 May 2017, the Court set aside the earlier decision that his complaint had failed. Dualway said it later increased Healy’s rate by €5 a day and backdated the payment to the start of his employment. The Court found the later payment could not undo the earlier breach, though it could be considered when setting compensation. No applicable collective agreement was brought to the Court’s attention.
