The Labour Court ordered Baku GLS Limited to pay international truck driver Vidmantas Mankauskas €3,000 after finding the company had not paid him the statutory minimum wage. The determination was signed on 12 September 2016.

The Court found that ferry journeys between Ireland and France or the UK counted as travel on official business when calculating working hours. Mankauskas was paid €350 a week, and the Court rejected the company’s alternative calculation of his hourly rate.

The Court also ordered €1,000 for Sunday work, finding no evidence his pay included Sunday compensation. It awarded €500 after finding that schedule changes sometimes came without 24 hours’ notice, and €250 each for breaches of his annual leave rights under sections 20 and 21 of the Organisation of Working Time Act 1997.

Two complaints under the mobile-worker regulations, about records and notification, were not well founded. Complaints under sections 11, 12, 13, 15 and 16 of the working-time law were not before the Court and were not considered further.
