The Labour Court upheld a €1,000 award to Kristina Sidaraite on Liam Hurley T/A Jingles Restaurant Ltd’s appeal. It found her complaint about unpaid annual leave and public-holiday entitlements well founded. The determination was dated 28 February 2013. Sidaraite worked as a waiter for Hurley from June 2011 to February 2012 and earned €7.50 an hour. She said she received no annual leave, cesser pay for outstanding leave or correct payment for public holidays worked. Hurley accepted that holiday and public-holiday pay remained outstanding, but said he did not know the amount and could not pay because the premises had been repossessed and the business had ceased trading.
