The Labour Court refused Hardijs Langsteins’s appeal against Able Security Ltd in a determination dated 31 January 2013, finding his remaining working-time complaints not well founded. Langsteins had withdrawn claims under sections 17, 19 and 21 of the Organisation of Working Time Act, 1997. He pursued claims under sections 11, 12 and 14 concerning daily rest, rest breaks and Sunday premiums. The Court examined two payslips covering a two-week period and found that he had been paid €9.03 an hour, rather than the €8 he alleged, and had received a Sunday premium for the Sunday worked in that period. His representative did not dispute the payslips, and the Court found the complaints lacked credibility.
