The Labour Court increased Mr Mihaly Kocsor’s award to €1,579.33 after he appealed the compensation for breaches of working-time and public-holiday rules. The determination was signed on 10 April 2012.

Kocsor complained that he regularly worked more than 48 hours a week and was underpaid for three public holidays. The Rights Commissioner upheld both complaints and awarded €1,100, including €129.33 for the holiday underpayment. Kocsor appealed the amount, saying he had worked more than 48 hours a week for 70% of his employment and that the compensation was inadequate. Noel Recruitment accepted both breaches but argued that the original award was fair.

The Labour Court rejected Kocsor’s application to extend the time limit for earlier breaches; the merits were not decided. It upheld the findings on the two breaches, found the compensation inadequate and varied the Rights Commissioner’s decision. The Court awarded €1,450 in compensation plus €129.33 for the public-holiday underpayments, bringing the award to €1,579.33.
