The Labour Court upheld Ms Ellen Whelan’s appeal, set aside the Rights Commissioner’s decision and awarded her €1,800 after finding her holiday pay complaint well founded. The award included unpaid holiday pay and compensation for breaches of the Organisation of Working Time Act, 1997.
The determination was signed on 2 August 2012. Ms Whelan said she received no annual leave or public holiday pay during her employment, including outstanding annual leave pay when it ended. Roddy Mooney McCarthy acknowledged that she had not received those entitlements.
