The Labour Court disallowed Jurate Vaiciulyte’s appeal against Daniel Lee T/A Window Fabrications, finding her holiday-pay complaint was not well founded. The Court dated its determination 23 November 2010. It found Vaiciulyte’s employment continued until 23 September 2009, but she was on lay-off during the leave year that began on 1 April 2009. The Court also found she had not given the statutory notice required for maternity leave, so the leave could not count towards holiday entitlement. It concluded she was not entitled to annual leave or public-holiday pay for the period claimed.
