The Labour Court disallowed William Fitzpatrick’s appeal and directed him to pay apprentice Daniel Whelan €450 for annual leave. The determination was signed on 28 October 2005. Whelan attended off-the-job FÁS training from February to July 2004 as part of his statutory apprenticeship. The Court found that the training was an integral part of the apprenticeship and counted as time worked for annual-leave purposes. It concluded that Whelan had not received his full entitlement and amended the Rights Commissioner’s decision.
