Labour Court rejects union appeal over maternity leave and seniority

The Labour Court rejected the Civil and Public Service Union’s appeal on behalf of a worker against the Central Statistics Office and the Department of Finance, finding she had not suffered discrimination over optional unpaid maternity leave. The determination was dated 12 December 1997. Her statutory maternity leave counted as service, but four weeks of optional unpaid leave did not. The Court said she was not obliged to take the optional leave and had been informed it would not count for service. The Union had argued that excluding the leave from seniority was direct and indirect discrimination.
