WRC finds Muiriosa Foundation support worker received break opportunities

The Workplace Relations Commission found that Kieran Battles’s complaint about rest breaks at Muiriosa Foundation was not well founded. Adjudication Officer Roger McGrath dated the decision 8 July 2026. Battles said that, while supporting residents in a residential house, he could not take proper breaks and that meals with residents and brief cigarette breaks did not count. The Foundation denied a breach, saying staff had flexibility to take breaks and access to a staff room. The officer found Battles had time when he was not supporting residents and could have taken breaks, pointing to his cigarette breaks and the available staff room. Battles had not raised a grievance about breaks during his employment.
