WRC awards four sums to former Foam Coffee House worker in mixed ruling

The Workplace Relations Commission awarded Marcio Antonio Rodrigues Junior €1,365 for Sunday work, €1,000 for missed rest breaks, €2,100 for failure to provide a statement of employment terms and €1,050 in lieu of notice against Foam Coffee House Limited. The decision was dated 2 December 2025. The WRC found the business had not shown that Sunday pay was included in his salary and accepted his evidence that proper breaks were not provided. It found the head chef’s reference to ending the sponsorship arrangement meant his employment had been terminated. The public holiday complaint was not well founded because he had not worked a public holiday within the cognisable period. Complaints CA-00071836-009, CA-00071836-012, CA-00071836-013, CA-00071836-017 and CA-00071836-018 were withdrawn; complaint CA-00071836-016 was upheld for notice.
