The Workplace Relations Commission dismissed Thomas Gaffney’s unfair dismissal and Payment of Wages complaints against Marks And Spencer (Ireland) Limited in a decision dated 9 July 2026. Gaffney alleged his 2024 dismissal, following a disciplinary process over alleged misuse of the colleague discount scheme, was unfair and that unlawful deductions were made from his wages. The company disputed both claims. The WRC dismissed the claims after Gaffney and his representative did not attend the relisted hearing. The adjudicator found there was no reasonable explanation for the absence; the merits of the claims were not determined at an evidentiary hearing. No award was recorded.
