The Workplace Relations Commission ruled it had no jurisdiction to hear Scott Henderson’s constructive-dismissal complaint against Whitbread Premier Inn Hotels, in a decision dated 25 February 2026. Henderson claimed he was forced to resign; the employer denied the claim and argued it was filed late. The adjudicator treated Henderson’s resignation on 29 July 2024 as the dismissal date and found his complaint was outside the statutory time limit. Henderson had accepted it was late, and the adjudicator was not satisfied that reasonable cause justified an extension. The WRC did not decide whether the dismissal was unfair.
