The Workplace Relations Commission found that the Health Service Executive treated Marie Ronan less favourably by requiring two years’ experience in a specialist role at a minimum of.5 WTE, and upheld her complaint under the Protection of Employees (Part-Time Work) Act 2001. The decision was dated 18 December 2025.
Ronan had challenged her exclusion at initial screening from an advanced specialist pharmacist competition, saying the threshold disadvantaged part-time applicants despite their aggregate experience. The HSE said it arose from expert and industrial-relations processes and was needed to provide specialist service. The adjudicator found the HSE had not established objective grounds for the threshold. A separate Employment Equality Act complaint in this file was rejected because it was addressed under a related file. No compensation was awarded here because redress had been issued under the alternative legislation.
