The Workplace Relations Commission (WRC) rejected Samantha Dwan’s disability discrimination complaint against Carmichael Ireland, finding she had not established facts from which discrimination could be inferred. Adjudication Officer Conor Stokes’s decision was dated 11 April 2025. Dwan’s complaint concerned a manager’s comment about her appearance that she said she had read in investigation notes. The company said it had not been formally notified of a disability and argued the evidence did not support an inference of discrimination. Stokes found the company was not on notice of a disability and that Dwan had not established the required facts.
