The WRC found an employee’s constructive-dismissal complaint was filed outside the time limit and declined to extend it. In a decision dated 15 October 2025, it found the complaint was statute barred and had no jurisdiction to hear it; the merits were not decided. The employee said he believed his solicitor was handling the complaint alongside a personal-injury case. He contacted the WRC within six months of leaving, learned he needed to file separately, then waited another five or six months before submitting the complaint. The adjudicator found the employee had not shown reasonable cause for the delay. The employer argued the complaint was out of time and that the delay was prejudicial.
