The Workplace Relations Commission awarded Tony Molloy €10,000 after finding Kaefer Limited unfairly dismissed him. Adjudication Officer Brian Dolan dated the decision 1 December 2025. A separate complaint under the Safety, Health and Welfare at Work Act was not pursued and was deemed not well-founded.
Molloy had refused to take work permits because he feared liability for defects, but later apologised and said he would comply. Kaefer said its client required Molloy’s removal from its site and no alternative work was available. The adjudicator found Kaefer did not adequately advocate for him or seek details of the client’s reasons; he also found Molloy’s conduct contributed to the dismissal.
