The Workplace Relations Commission found Regina Walsh was unfairly dismissed by Bke Care Ltd t/a Bluebird Care Carlow, Kilkenny & Waterford and ordered €660 compensation. The decision was dated 30 May 2025.

The company said it dismissed Walsh for serious misconduct, including being paid for care calls she did not attend or complete and failing to follow reporting procedures. Walsh accepted she was paid for incomplete calls and said customers sometimes told her not to attend or leave early; she said she sometimes notified On Call.

The adjudicator found the company had substantial grounds for dismissal but that procedural failings made the dismissal unfair. The investigation findings were not fully shared, and Walsh did not have a meaningful chance to respond before the decision to dismiss was made. The adjudicator also found Walsh contributed to her dismissal.
