The Workplace Relations Commission found that Sodexo Ltd’s requirement for Marzena Jalowska to speak English as the business language was indirectly discriminatory on race grounds, but objectively justified. Adjudication Officer Patsy Doyle’s decision was dated 30 March 2026; no monetary award was recorded.

Jalowska alleged race discrimination in her working conditions, harassment and victimisation. Sodexo denied discrimination and said English was needed for operational and safety reasons, with translation and language-learning support offered. The WRC found that direct discrimination, race-related harassment and victimisation were not established, and the overall race-discrimination claim did not succeed.
