The Workplace Relations Commission has directed Keegan Quarries Limited to pay Jaroslaw Elwartowski €15,000 compensation after finding he was unfairly dismissed. In a decision dated 14 May 2025, it also upheld his complaint over unpaid notice pay and directed a separate payment of €2,857.33.
Elwartowski said he was dismissed after his solicitors sent the company a letter concerning personal injury proceedings. The WRC found that the reason for dismissal had been conveyed to his brother rather than to him, and that the dismissal was substantively and procedurally unfair. Keegan Quarries did not attend the hearing, although the decision records it had notice.
The notice pay complaint concerned one month’s contractual pay that Elwartowski said he had not received. The WRC upheld it.
