The Workplace Relations Commission declined jurisdiction over Elizabeth Flynn’s complaint alleging discrimination on the ground of membership of the Traveller community when seeking service at the Kestrel Inn. Adjudication Officer John Harraghy’s decision was dated 13 November 2024. Phoenix Inn Limited t/a Kestrel House argued that the claim belonged before the District Court under section 19 of the Intoxicating Liquor Act 2003. Flynn argued that the provision was incompatible with the Equal Status Act and sought an adjournment. The WRC found the complaint was not admissible before it; it did not decide whether discrimination occurred. No award was recorded.
