The Workplace Relations Commission found that Sean Ahern Ltd’s sick-pay scheme was more favourable overall than statutory sick leave, rejecting electrician Alan Lehane’s claim for pay for three days’ absence. The decision was dated 15 November 2024. Lehane said the Construction Workers Pension Scheme paid only from the fourth day and argued statutory sick pay should cover the first three days. The company said its scheme replaced the statutory entitlement. The adjudicator accepted that the scheme’s cover for up to 50 days outweighed its three-day waiting period.
