The Workplace Relations Commission found that Christopher Madden had not established constructive dismissal in his case against FedEx Express Ireland Limited. The decision by Adjudication Officer Michael McEntee was dated 20 January 2025, and no award was recorded. Madden, an Administrator/Dispatcher, said the handling of a recruitment grievance, removal of a long-standing split-shift payment and return-to-office arrangements left him feeling he had no future at the company. FedEx said the return-to-work policy was set centrally and managers had tried to find workable arrangements. The adjudicator found no fundamental breach of contract and said management’s conduct was not so unreasonable as to justify resignation. He also considered that Madden could have raised a grievance about the new arrangements. Constructive dismissal means an employee resigns because the employer’s conduct makes it reasonable to leave; the complaint failed.
