WRC orders company to pay worker €3,200 compensation and €800 gross leave pay

The WRC ordered a company to pay a worker €3,200 compensation for failing to provide written terms of employment and €800 gross for accrued annual leave. The decision was dated 13 February 2025. A separate penalisation complaint was withdrawn. The company argued that the arrangement was commercial rather than employment. The WRC found that the worker was an employee under an implied contract of service, taking account of the company’s control over his work and other aspects of the working arrangements. The WRC found the annual-leave complaint well founded and required payment of €800 gross in lieu of accrued leave. It also found the written-terms complaint well founded, saying the lack of written terms denied the worker statutory rights, and ordered €3,200 compensation. The third complaint was withdrawn.
